A judge in Coín has ordered pre-trial custody in prison for a man who maintained sexual relations with a minor. The relationship was denounced by the mother of the young girl.
The man, aged 27 years, was a temporary lodger with the mother and her daughter after he split with his girlfriend and it would appear that, unbeknown to the mother, he had built up a clandestine relationship with the young girl, now thirteen years old.
The mother came home on Friday night to find the man in bed with her daughter and she immediately went to the Guardia Civil to make a denuncia. A subsequent investigation by the Guardia Civil found that the relationship was ‘consensual’, although in the case of a minor such consent is considered ‘flawed’. The penal code regards sexual relations with a child of twelve years or younger as ‘non-consenting’ and the Guardia Civil are carrying out a further investigation to ascertain whether, if the relationship had been going on for several months, as seems likely, the girl was only twelve years old at the time.
