Ombudsman gives up

According to the Town Hall, a letter has been received from the Ombudsman for Andalucía, José Chamizo de la Rubia, in which he states that he sees no justification for further action regarding the dispute between the Council and the Association of Market Traders (AVAM) and intends to ‘file’ the case.

The letter states that the Ombudsman has analysed the documentation provided by the Council and has found that the city complied with the conditions listed by the Junta de Andalucía in its proposal for mediation in the dispute.

It further states that the decision on the location of the market is something which falls within the scope of the powers of the Municipality of Nerja and the Ombudsman cannot see how this decision could be derived from an action which is contrary to the law.

The letter concludes by stating that, as the dispute continues despite mediation on the matter, and given that the Council has not acted in an irregular manner, he sees no justification in further action on his part and intends, therefore, to file the case.
