A court in Sevilla has awarded €2,000 compensation to a family whose peace and quiet was disturbed by a water pump.
In order to boost the water pressure, the defendants had installed a water pump which began pumping at night. However, it exceeded the permitted noise level by 10 decibels.
The judge at the Court Number 2 in Sanlucar la Mayor also prohibited the reuse of the water pump until a qualified technician had inspected it and carried out any necessary adjustments.
The defendants, however, had already stopped using the pump and gone over to a solar powered system.
The judge ruled that the complainants had suffered noise affecting their privacy and this led to a situation of distress or anxiety, violating their fundamental right to privacy and inviolability of the home.
