After three years of controversy and ninety denuncias, the TSJA (High Court of Justice in Andalucia) has ruled that Vialia can open on Sundays because it benefits from an exception to the Ley de Comercio Interior de Andalucía (Domestic Trade Act of Andalucia) relating to business premises in transport stations.
The CC. OO. and UGT Unions and the Málaga Business Federation, Fecoma, argue that section 20.1 of the law does not apply because the rail station is not isolated and so is accessible by anyone, unlike the situation in airports where shops are segregated and for the use of travellers with valid tickets.
Howver, the TSJA disagrees and Vialia can open on Sundays and holidays if it so wishes. Nesco, the owners of Vialia, would prefer consensus with shops, unions and EMCF relating to opening on Sundays and holidays.
