The High Court of Justice for Andalucia, the TSJA, is set to invalidate the licenses for 51 dwellings built in Almuñécar, Granada province, in 2002.
The ruling government in Almuñécar at that time, comprising the PSOE, PP and PILH, voted overwhelmingly to approve a Detailed Study for the construction of 51 homes in the Los Pinos area of the town and agreed to dismiss any future complaints which may arise because the project was in full compliance with the existing planning laws.
The Junta de Andalucia brought an action in 2002 on the grounds that the licence breached the provisions of the prevailing PGOU (General Plan) and that an amendment made to the General Plan was not permitted under the Detailed Study.
