A man arrested on Tuesday and accused of indecent exposure on the Costa Natura nudist beach in Estepona has been fined €2,400 euros for exhibitionism.
The man, a 30 year old Maghreb, was arrested after several parents on the beach denounced him for masturbating in front of their children and then walking along the beach with an erection.
The defence strategy was to question whether one could actually talk about exhibitionism on a nudist beach where, by its very nature, the users are naked.
The accused denied masturbating but did admit to having an erection, something he said was ‘difficult to hide’ on a nudist beach.
For the crime of indecent exposure, the Criminal Code provides for penalties of six months to one year in prison or a fine of 6-12 months.
However, as the defendant admitted the charge, the sentence was less severe and a fine of €2,400 was imposed. Apparently, the defendant returned to the same beach within fifteen minutes of leaving the court.
