The Málaga Provincial Public Prosecutor is asking for a nine year prison sentence for the former president of the Capistrano Playa Community, a British national, for the alleged crime of embezzlement.
The former British president, 51 year old M.T., was arrested in May 2009.
It is alleged that between 2006 and 2009, the accused cashed cheques to the value of €31,980 under the pretence of paying for work to be carried out in the community. These jobs, it turned out, were never actually paid for.
As president, the accused was also responsible for receiving contributions for the maintenance of a number of apartments and then handing them over to the community. These contributions, amounting to around €27,000, were allegedly never handed over.
M.T. is also accused of coercing various residents to sell community garage spaces which they didn’t actually own, diverting funds left by one resident for the payment of inheritance tax and accepting €30,000 as mediator in a real estate deal which never went through.
The prosecutor is also asking for the accused to pay €31,980 back to the community and €119,746 to eleven of the property owners in Capistrano Playa.
A private lawsuit filed by the Community seeks a twelve year prison sentence for misappropriation of funds, fraud and forgery of documents plus payment of €300,000 compensation.
