Fines for infringement of the new anti-smoking laws range from €30 to €600 for offenders and up to €600,000 for the owners of properties who disobey the law.
Smoking is not permitted in confined public areas, defined as any place accessible to the public or for collective use, regardless of public or private ownership, public or collective transport and on terraces with a maximum of two walls.
The exceptions to the rule are:
Hotel owners may designate a maximum of 30% of rooms where smoking is permitted. These rooms must be fixed, be separated from the rest and marked with signs. Employees can not access them while a customer is inside, except in cases of emergency.
Outdoor spaces in universities exclusively devoted to adult education, provided there is no immediate access to surrounding buildings or pavements.
Prisoners are allowed to smoke, as are psychiatric patients and long term residents of nursing homes or facilities for the disabled. These can be outdoor areas or in specially equipped closed rooms which are clearly marked and independently ventilated.
Smoking is also permitted for members of private smoking clubs. Such clubs are required to be legal entities, non-profit and must not engage in commercial activitie. Minors are not permitted to enter such establishments.
It is estimated that 31% of people in Andalucia are smokers.
