The Court of Contentious Administration Number 3 in Málaga has apparently ruled in favour of Nerja Council relating to a claim by Medgroup for the return of €15 million, plus interest, due to the suspension of the golf course project.
Medgroup bought land near the Nerja Caves and La Colladilla from the Council in 2003 in order to construct an 18 hole golf course, a luxury hotel and 1,000 luxury homes.
However, in 2006, the Spatial Plan of the Axarquia (Potax) came into force and the lands, near or in the Parque Natural Sierra Almijara, were classified as protected and the project had to be abandoned.
Medgroup began legal action in 2007 to recover the €15 paid to the Council for the land, plus interest.
The mayor is hoping that with a possible change in government, both at regional and national level, there is still a chance that this project, deemed vital to the future of Nerja, will eventually go through.
