The former Mayor of La Viñuela, Juan Millán Jabalera (PSOE), will become the first former leader of a small town in Málaga province to a jail sentence for urban planning crimes when he reports to Alhaurín de la Torre prison on Thursday.
The former Mayor was convicted on three charges of urban planning violations relating to the illegal granting of licences in 2001 and 2003.
Millán, who resigned from office in February, was sentenced to 27 months in prison (9 months for each offence), 15 and a half years disqualification from holding public office and ordered to pay a fine of €13,515.
Millán and his lawyer made a deal with the Public Prosecutor whereby a further dozen or so further pending cases would not be pursued provided he admitted his guilt and went to prison. Millán is benefiting under Article 76 of the Penal Code whereby the the maximum penalty enforcement shall not exceed three times that of the most serious sentence, as long as the offences are considered related.
By making the agreement, Millán will avoid the potential financial ruin that could ensue if numerous fines were to be imposed relating to other cases.
Once reporting to prison, Millán intends requesting ‘third degree’ status.
