The former president of Urbanisation Capistrano Playa in Nerja, British national M.P.T., has reached an agreement with the Public Prosecutor and will serve a sentence of four years for fraud and misappropriation of funds.
M.P.T. was president of the Urbanisation Capistrano Playa between 2006 and 2009, during which time he misappropriated funds belonging to residents, charged for work which was not carried out, received maintenance and other fees which never reached the community coffers and sundry other fraudulent acts.
M.P.T. was arrested in 2009 and spent 16 months in custody. The four year sentence agreed between the various parties, including residents of Capistrano Playa, is substantially less than was originally being demanded by the public prosecutor (9 years imprisonment) and the private prosecutor (12 years imprisonment).
The agreement was reached in order to avoid a further hearing planned for March 6th and 7th. In addition to accepting a four year sentence, M.B.T. has accepted civil liability of €151,000 and will not be allowed to hold similar public office or be involved in any activity involving the management of patrimonial funds for a period of four years and will be liable for the court costs.

What a farce! I guess four years is better than nothing. This reprobate should have been thrown in a dungeon for at least the 12 years recommended by the private prosecutor. After release from the initial prison term, this man could be seen all over Nerja. Still cocky. Still arrogant and condescending. No remorse whatsoever. I doubt he’ll be any different 4 years from now. And good luck to anyone believing they will ever see a penny from the civil liability suit. When he gets out he’ll probably run for mayor!
