The Provincial Court in Córdoba has upheld the judgement against M.R.S.D. for the reckless homicide of Nerja PP Councillor José Luis Pezzi during a hunting expedition on November 17th 2006.
The defendant has been sentenced to two years imprisonment, three years deprivation of the right to possess weapons, forfeiture of the weapon used during the expedition and must pay costs and compensation to the family of the deceased.
The incident occurred at 14:05 on November 17th 2006 during a hunting expedition on Dehesa del Alcornocal farm between Posadas and Almodóvar del Río in Córdoba.
The defendant had appealed the sentence on the grounds that the deceased had shifted position by 1.9 metres during the hunt, thus contributing to the accident. The Court decided that, regardless of any movement, this did not alter the fact that the shot was fired, improperly, towards his position and the movement made was merely arising from his seat, an action considered ‘normal’ during a hunt.
In addition, the shot fired by the defendant not only killed José Luis Pezzi but also hit the trouser leg of his companion.
José Luis Pezzi was a member of the PP in Nerja between 1995 and 2003 and was Councillor for Planning, Environment, Public Safety and Personnel.
