José Franco de la Cruz, alias “el Boca”, who was released in April after serving 21 years of a 44 year sentence for the rape and murder of Ana María Jerez Cano in 1991, has been arrested in Madrid on suspicion of rape.
A 39 year old woman says she was approached by El Boca as she entered a shelter. After the rape, which took place near the building, she went to the police where she was able to identify her assailant.
El Boca had been arrested the day before for threatening social workers at the same establishment and had used the same knife on that occasion and during the rape.
On February 16th, 1991, Ana Cano disappeared in Huelva and on April 26th her body was found floating in the Rio Tinto. The mother had argued , in vain, for the application of the ‘Parot Doctrine’ which would have prevented the release of El Boca for another ten years.
He was released from Morón de la Frontera prison in Sevilla in April after the failure of the application by the family of the deceased girl.
