The Superior Court of Justice in Andalucia (TSJA) has reportedly ruled in favour of Nerja Council and it does not have to return the €15 million paid by Med Group for land it bought for the purpose of building a golf course, hotel and residential homes.
Med Group paid for a plot of land on which to build a leisure complex but the project failed when the Junta de Andalucia declared the lands to be protected and therefore non-developable.
Med Group had been claiming the return of their investment, some €15 million, plus damages and costs. Under the latest ruling, which cannot be appealed, Med Group will have to pay the legal costs.
Nerja Council recently won another case against the Junta de Andalucia relating to several articles in the POTAX (Spatial Planning in the Axarquia), a plan designed to regulate construction in coastal and protected public areas. The ruling paves the way for the resurrection of projects to build hotels, residential homes, golf courses and marinas.
