The head of the Court of Instruction Number 2 in Málaga has dismissed all charges and closed the case against five men, two of them minors, who were detained for allegedly raping a girl at Málaga Feria.
After taking statements from several witnesses to the incident and analysing evidence, including a mobile phone recording, the judge ruled that it was not possible to prove that a crime had been committed.
The defendants claimed that they had met the girl, had a few drinks together and that two of them had then had consensual sex with her. The girl’s story, on the other hand, is that she was accosted on her way from work and that all five of the individuals participated in the attack in one way or another.
The defence lawyer has apparently already lodged an official complaint of perjury against the plaintiff.
