The Court of First Instance and Instruction Number 1 in Torrox has acknowledged that an order issued on July 4th 2014 to open proceedings against the mayor of Nerja, José Alberto Armijo, relating to an urban planning violation was ‘an error’.
The case dates back to 2006 and the issuing of a building licence for the girlfriend of Partido Andalucista Councilor Javier Martín Losada, the property being near the Sports Centre in the north of the municipality.
The case still reportedly involves municipal architect Juan Rafael Gómez Martín and lawyer Antonio García Ramírez for the alleged crimes of forgery and crimes against urban planning. The pair had reportedly earlier rejected a building licence request for the same plot made by a different individual.
The Public Prosecutor has apparently asked on two previous occasions for the July 4th 2014 order, which erroneously includes the name of the mayor, to be archived. The mayor of Nerja was reportedly excluded from the case in April 2012.
The Council itself has expressed concern that the erroneous inclusion of the mayor in the case has been used for political ends in order to cause damage to the image of the mayor, and is studying all published material on the matter to determine whether there is a need to take legal action.
